PLEASE READ THIS NOTICE. IT CONSTITUTES PART OF YOUR CONTRACT FOR TRAVEL RELATED SERVICES. CHECK YOUR DOCUMENTS CAREFULLY FOR ACCURACY WHEN YOU RECEIVE THEM. CONTACT THE TRAVEL AGENCY IF YOU HAVE ANY QUESTIONS. MOST DISCOUNT FARES INVOLVE RESTRICTIONS, AND CHANGING CARRIERS OR FLIGHTS COULD RESULT IN THE AIRLINE DEMANDING AN INCREASED FARE PLUS PENALTIES. CHECK WITH OUR TRAVEL AGENCY BEFORE MAKING ANY CHANGES.
AVENUE TRAVEL SERVICES CORPORATION, a Delaware corporation (herein “Travel Agency”) is acting as a mere agent for our SUPPLIERS in selling travel-related accepting services, or in accepting reservations or bookings for services that are not directly supplied by this Travel Agency (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.). Avenue Travel Services, therefore, shall not be responsible for breach of contract, failure to comply with any laws such as the Americans with Disabilities Act (ADA), or any intentional, negligent actions or omissions on the part of such suppliers, which result in any loss, damage, delay, inconvenience or injury to travelers or travelers’ companions or group members.
Avenue Travel does not guarantee any of our supplier’s rates, bookings, reservations, connections, scheduling, or handling of baggage or other personal effects. Travel Agency shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, abnormal conditions or developments, or any other actions, omissions, or conditions outside the travel agent’s control. In the event of a tariff or rate dispute with one of our suppliers, the traveler must contact Avenue Travel Services at the earliest possible time.
Traveler agrees to pay all valid credit card charges processed by the Agency or its
designees, for any service or supplier authorized on behalf of the Traveler. Some
airlines dispute agency tariff interpretations. If we are debited by the carrier
for any Traveler requested itinerary, the traveler agrees to reimburse our agency
for costs and expenses imposed by the airline carrier and paid by the agency. All
use of such tickets is done at travelers' risk and agency shall not be responsible
for any consequences that may result.
Avenue Travel will seek all available legal
remedies due to credit card charge backs or returned check fees. We do file charges,
seek criminal prosecution and have arrest warrants issued for the fraudulent use
of credit cards and returned checks. The Agency will report all late payments and
return checks to a credit bureau at our discretion. We will also seek restitution
for legal and court fees if incurred.
The Traveler assumes complete and full responsibility
for, and hereby releases the agent from, any duty of checking and verifying any and
all passport, visa, vaccination, or other entry requirements of each destination,
and all safety and security conditions of such destinations, during the length of
the proposed travel. However, we specifically recommend that U. S. Citizens traveling
to Canada, Mexico or the Caribbean, do so with a valid U. S. Passport. For information
concerning possible dangers at international destinations, contact the Travel Advisory

on-line travel advisory service (http://travel.state.gov/travel_warnings.html). For

Avenue Travel does not guarantee delivery of tickets. If the traveler elects to have paper tickets issued where electronic tickets are an option, the traveler assumes all responsibility for both the cost of replacement tickets and the payment of a lost ticket application fee if the tickets are lost enroute.
The Agency may, on occasion, issue tickets through third party consolidators for
the purpose of obtaining lower fares for the traveler and/or obtaining a higher commission
rate for the Agency. Traveler agrees to pay all charges processed on behalf of the
Agency by third party processors or consolidators.
Airfares are not guaranteed until
ticketed, and may change at anytime without notice. A guaranteed airline reservation
does not guarantee the pricing of an airline ticket, and tickets will not be issued
until specific instructions are sent to our agency to issue the tickets. Email or
voicemail ticketing authorization does not constitute a guarantee of ticketing, and
travelers are advised to call our office and speak to an agent to authorize final
ticketing.
The Agency's transaction fees (also sometimes referred to as service or ticketing
fees) entitles the Traveler to no special legal considerations, other than the issuance
of an airline ticket or other specifically mentioned service. The Agency or any of
our employees may increase, decrease or waive the service fees at anytime and for
any reason.
By embarking upon his/her travel, the traveler voluntarily assumes all
risks involved in such travel, whether expected or unexpected. Traveler is hereby
warned of the above risks as well as possible travel industry bankruptcies and medical
and climatic disruptions, and the possibility traveler may be unable to travel as
scheduled because of personal emergency. Traveler is advised to obtain appropriate
travel insurance coverage against these risks; information is available through this
Travel Agency regarding travel insurance. Traveler’s retention of tickets, reservations,
or bookings after our issuance shall constitute a consent to the above agreement
in its entirety, and an agreement on his/her part to convey the contents hereto to
his/her travel companions or group members.
